How is this McDonald's fault? I mean, this strikes me as nothing more than a cash grab.

Another article that does a better job of explaining the "case" the parents brought. It's still just as misguided. Yes, I understand you miss your children, but there was nothing there for them to blame Mcd's.

so 2 teens are at McDonald's, get into a fight in the parking lot, one has to go to the hospital but is killed by a red light runner. Apparently it was McDonald's fault for not having security.

Why not charge the guy who put the other one in the hospital to begin with, or the red light runner than actually killed the individual. Nope, we were outside a major corporation building so we'll fill our pockets.

I ate at Chipotle and had to stop at a Wawa so I didn't crap my pants. Then my car got broken into in the Wawa parking lot so I stopped the burglar but broke his nose so now I have to pay for his medical bills. I'm suing Chipotle.

It's got to be something about them fighting in their parking lot. It might have been McDonald's responsibility to try and break up the fight or call the cops or something, but maybe their policy or employees refused to act, which elevated the conflict to deadly levels.

Also, if you're going to cash grab, might as well do it from a business like McDonalds. Not saying it's right or wrong, but that I don't feel like a huge injustice was done here with the charges.

What kind of security is McDonald's supposed to have, exactly? This isn't a Bank. They don't have armed security guards.

Exactly, it's the responsibility of the police department. How much trouble would they be in if they had hired a security guard that had detained them all? The police would have jumped down their throat about acting outside their legal ability.

The way that I see it is that potentially the jury believed that there was negligent security on the part of McDonald's. This allowed the beating to occur on their property. It is foreseeable that after a beating, which theoretically would not have happened assuming McDonald's had proper security in place, there may be an accident on the way to seek medical treatment. In other words, "but for" the negligent security of McDonald's, the teens would not have been forced to seek medical attention. Just my two cents/opinion, for what its worth.

Wasn't there a recent ruling that decided that people can go after franchisers instead of independent franchisees even for totally localized issues? This may be a predictable side-effect of that. McDonalds Corp has lots of money, certainly way more than whoever owns the restaurant where the fight happened, so let's go after them and get us some.
